Counterfeit Update

Dear Ubiquiti customers,

We are pleased to let you know that we have recently won a number of victories in our worldwide anti-counterfeiting and brand protection campaign.

1. In the U.S.:
In June, the U.S. federal court of the Northern District of California issued a temporary restraining order prohibiting William (Shao-Wei) Hsu (a/k/a Guillermo Hsu, William Wu) and anyone in active concert or participation with him from counterfeiting, infringing upon Ubiquiti's trademarks and destroying any evidence of infringement. See http://finance.yahoo.com/news/ubiquiti-obtains-court-order-against-204500962.html.

In early July, the U.S. court ordered a preliminary injunction against William Hsu and his cohorts to the same effect. In addition, the court froze all of Hsu's real estate assets in the U.S., and allowed Ubiquiti to seek early discovery to reveal the source of certain defamatory rumors against Ubiquiti. See http://finance.yahoo.com/news/ubiquiti-wins-preliminary-injunction-against-100000468.html.

2. In Argentina:
In June, the Argentina court issued a copyright injunction against William Hsu and his Argentine companies (e.g. Syntronic, Tech Depot, Connectis) prohibiting them from counterfeiting and the illegal use of Ubiquiti's software.

In July, the Argentina court enforced the copyright injunction against William Hsu and his companies. The Argentine court marshal searched Hsu's shops and warehouses and seized counterfeit products.

3. In China:
As many of you know, in late 2011, the Chinese authorities had shut down the Hoky counterfeiting factory in Shenzhen, owned by William Hsu's accomplice Kai (Kenny) Deng. Deng has been determined by the Chinese authorities to be a criminal suspect and is currently behind bars awaiting trial.

As you can see, we have been and will be vigorously pursuing the counterfeiters in order to protect our customers and the Ubiquiti brand name. As the various legal actions proceed, we will obtain through the court discovery process in various countries records revealing the identity of those who worked with the counterfeiters. While we are otherwise committed to bring to justice all who have bought from or worked with the counterfeiters, we realize that some may have been tricked by the counterfeiters into working with them.
